A Magistrate’s Court in KuGompo City, Eastern Cape, has handed Economic Freedom Fighters (EFF) leader Julius Malema an effective five-year prison sentence following his conviction in a firearm-related case stemming from a 2018 incident.
The ruling is tied to events during the EFF’s fifth anniversary celebrations in Mdantsane, where Malema was found guilty of discharging a firearm in a public setting, an act deemed to have endangered the safety of those in attendance.
During sentencing proceedings on Wednesday, the prosecution pushed for a custodial sentence, arguing that the gravity of the offense warranted imprisonment. State prosecutor Advocate Joel Ceasar emphasized that Malema had demonstrated no remorse, particularly highlighting the potential risk posed to the public.
In contrast, Malema’s defense team argued for a non-custodial sentence, urging the court to consider alternative penalties. Despite these submissions, the court ruled in favor of a prison term.
Following the judgment, the EFF swiftly signaled its intention to challenge the decision. Party representatives expressed confidence in their legal team, noting that Malema has consistently complied with court processes since the case began in 2018 and has not missed any court appearances.
They further argued that Malema does not pose a flight risk and is expected to seek bail pending appeal. According to the party, legal efforts are already underway to secure his release while the appeal process unfolds.
The case has drawn significant attention, raising broader questions about accountability, leadership conduct, and the legal consequences of public actions by political figures.
