Jovanus Turay the boy who killed Precious Ireland a student of the Cyber-Ed School which he is also attending, has finally been Charged with Negligent Homicide while his Mother Josia M Saah was also charged with recklessly Endangering Possession and sale of objects for lethal use in violation of chapter 14 section 14.3, chapter 14 section 14.23 and chapter 17 section 17.11 respectively and sent to court for prosecution.
But later on they were released on bill by their lawyer and are currently awaiting further trial.
A statement from the Temple of Justice said that the Police in Monrovia have finally charged and forwarded to court 16-year- old Jovanus Oliver Turay who accidentally shot and killed his schoolmate, late Precious Ireland. He was charged alongside his mother Josia Ma-watta Saah.
The late Precious Ireland was laid to rest in the 29th of April 2020 and the family openly declared that they’ve forgiven Jovanus and his family and bless them to live peacefully.
Following the unfortunate situation on Monday, April 13, 2021, there has been claims and counter claims as to whether or not the minor can be held liable for his action citing section 4.1 of the 1971 penal law.
Section 4.1 of the penal law of Liberia states a person is not responsible for his behavior when he or she was less then 16 years old.
In any prosecution for an offense, lack of Criminal responsibility by reason immaturity is an affirmative defense.
This move by the Justice Ministry brings up the questions of; will the Ireland family still further pursue their case or let it slide And allow Government to do the prosecution according to law? As Murder and or Manslaughter is a state crime.
